Dhanuka Agritech Limited, one of India’s leading agrochemical companies, has secured a significant legal victory in the Delhi High Court, passed by Justice Tejas Karia against Agrim Wholesale Private Limited and other unknown parties for unauthorised use of its trademarks, including the registered “DHANUKA” mark.
The suit, filed under CS(COMM) 1056/2025, sought a permanent injunction restraining trademark infringement, passing off, dilution, unfair competition, and also requested rendition of accounts, damages, and delivery up of infringing products.
The Court recognised Dhanuka Agritech’s long-standing reputation, goodwill, and statutory compliance in the agrochemical sector. With a strong nationwide presence, four ISO-certified manufacturing facilities, and a revenue of Rs 2,035 crores in FY 2024-25, the company has built significant trust among farmers, distributors, and dealers across India.
Dhanuka Agritech has alleged that Agrim Wholesale sold unauthorised and counterfeit agrochemical products using Dhanuka’s marks, violating licensing and certification requirements under the Insecticides Act, 1968, and Insecticides Rules, 1971. Despite claiming to be an intermediary, Agrim Wholesale is reportedly selling low-quality infringing products via its mobile application, promoting them under both an “Infringing Products” category and the “Popular Brand Category,” misleading consumers and harming Dhanuka Agritech’s reputation and business.
The Delhi High Court has granted an ex-parte ad-interim injunction restraining the Defendants from using Dhanuka Agritech’s trademarks or any deceptively similar marks. The order also bars them from selling, soliciting, advertising, importing, exporting, or offering for sale any counterfeit or unauthorized agrochemical products bearing Dhanuka marks, including through e-commerce platforms. Additionally, the Defendants are restrained from engaging in any acts that may mislead customers or dilute the goodwill and reputation of Dhanuka Agritech.
The Court has also appointed local commissioners to inspect the Defendants’ premises. With the assistance of the Gurugram Police (Sector 65) and the support of Dhanuka’s legal team, the local commissioner conducted the raid and collected records, accounts, licenses, and various other relevant records to ensure compliance.
Agrim have been directed to remove infringing listings within 72 hours of notice.This legal intervention reinforces Dhanuka Agritech’s commitment to protecting its intellectual property and ensuring farmers access genuine, safe, and high-quality agrochemical products. The case will be further heard on January 29, 2026.
